License
Last updated
Every Appica theme and template is sold with 1 license: 1 end product, for yourself or for 1 client, with every future update. This is the full text; the product pages carry a summary.
1. About this license
This license is an agreement between you and Roman Kalinin trading as Appica (“Appica”, “we”, “us”). “You” means the person who buys the license or, if you buy for an organization, that organization. Polar sells the license to you as our merchant of record; we grant it. It covers the product and edition named on your receipt, including its source code, documentation, sample data and every update you receive (together, the “Product”).
2. Definitions
- End product means 1 website, web store or web app, for 1 business or brand, that you build with the Product and that adds your own content, design or features, so that it is clearly a different thing from the Product. Copies of it for development, staging and testing, and the regional or language versions of the same business, count as the same end product.
- Client means a person or business you build an end product for as a service, paid or not.
- End user means anyone who visits or uses an end product.
3. The grant
When your payment completes, we grant you a non-exclusive, worldwide and perpetual license to use, copy and change the Product to make 1 end product. It can't be transferred, except as section 5 allows. Each further end product needs a further license. All rights not granted here stay with us.
4. What you can do
- Build 1 end product for yourself, your organization or 1 client.
- Use it commercially. The end product may be free or paid: it may sell goods, take payments, show ads or charge end users, including as a software-as-a-service (SaaS) product with any number of paying end users.
- Change the Product as much as you like and combine it with other work. You don't need to credit us.
- Let any number of people work on that end product, such as your employees, your contractors and your client's team, as long as they use the Product only for it.
- Keep using the versions you received for as long as the license lasts, even if we stop selling or updating the Product.
5. Client work
You may build the end product for 1 client and transfer it, with this license, to that client for any fee. Once it is transferred, the license belongs to the client, and you may keep a copy only to maintain that end product for them. Give the client a link to this license. Apart from this, you may not transfer, sell or sublicense the license.
6. What you can't do
- Redistribute, sell, sublicense, share or give away the Product or any substantial part of it, as it is or changed, for a fee or free. This includes offering it as a template, theme, starter kit, boilerplate, UI kit, design file, component or block library, plugin or code generator, or porting it to another framework or platform to offer it that way.
- Use the Product in a website builder, store builder, generator, AI app builder or any other product or service that lets others create their own websites, stores or apps from it or from parts of it. A SaaS product that gives each of its customers a storefront built from the Product is such a service.
- Publish the Product's source code, or the source code of an end product that contains it, in a public repository or anywhere people outside the end product's team can download it.
- Use 1 license for more than 1 end product, or share your license key or downloads beyond the people section 4 allows.
- Claim that you made the Product, or remove the copyright notices from its source files. The notices don't need to be visible to end users.
- Include the Product in a dataset offered to others for training AI models. Using AI coding tools on your own copy is fine.
7. Open-source parts
The Product is built on open-source packages, including Appica UI (@appica/ui-react, @appica/icons-react and @appica/country-flags-react), released under the MIT license. Those packages stay under their own licenses, and nothing here limits the rights they give you. This license covers the Product's own code, design, documentation and sample data, which are not open source.
8. Demo and sample content
Product names, descriptions, photos, logos and brands in the live demos and the sample data are placeholders that show how the Product works. They are licensed for development, testing and previews only. Replace them with your own content before you launch your end product.
9. Design files
Where an edition includes design files, such as a Figma file, they are part of the Product and licensed on these same terms, for the same end product.
10. Updates
Your license includes every future update of the edition you bought, major versions included, at no extra cost, for as long as we publish that edition. You download them from My purchases. We decide what each update contains and may stop updating an edition; the versions you already have stay licensed to you. A different product sold separately is not an update.
11. Support
We give support by email at support@appica.dev for questions about the Product's documented features, help getting it running as shipped, and bug reports. We aim to reply within 2 business days. Support doesn't cover changes or new features you want, code you wrote (such as your commerce adapter), third-party services, hosting or general programming help.
12. Refunds
Refunds follow our refund policy. A refund or a chargeback ends this license.
13. Ending the license
This license ends automatically if you break it and don't put it right within 14 days of our notice, or at once if you break the first 3 points of section 6. When it ends, you must stop using the Product and delete your copies. A license you already transferred to a client under section 5 continues for that client.
14. Ownership
We own the Product and all intellectual property in it. You own what you add. This license gives you no right to use the Appica name or logo, apart from saying truthfully that your end product is built with the Product.
15. No warranty
The Product is provided “as is”. To the extent the law allows, we give no warranties beyond what this license states, including that the Product is free of errors or fits a particular purpose. If you buy as a consumer, you keep your statutory rights, for example under the Consumer Rights Act 2015.
16. Limit of liability
Our total liability under or in connection with this license is limited to the amount you paid for it. We are not liable for loss of profit, revenue, data or business, or for indirect or consequential loss. Nothing in this license limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law doesn't allow to be limited.
17. Changes to this license
We may publish new versions of this license for future purchases. Your purchase stays under the version that applied when you bought it, unless you agree otherwise.
18. Governing law
This license is governed by the laws of England and Wales. If you are a consumer, this doesn't take away the mandatory protections of the law where you live, and if you live in the UK you can bring proceedings in the courts of the part of the UK where you live.
