Terms of Sale

These terms apply when you buy a theme, template or plugin on appica.dev. Please read them with the license and the refund policy, which are part of the same agreement.
Who sells to you
Purchases on appica.dev are processed by Polar Software, Inc. (“Polar”), which acts as the merchant of record. Polar is the seller of your order: it takes the payment, calculates and remits sales tax and VAT, and issues your receipt and invoice. Your purchase is also governed by Polar's Checkout Buyer Terms.
The products are made and licensed by Roman Kalinin trading as Appica (“Appica”, “we”, “us”). We grant the license that sets out how you may use what you bought.
What you buy
You buy a license to use a product, not the product itself. Every product is sold with 1 license, for 1 end product; the license sets out what it allows. All rights not granted by the license remain with us.
Prices and taxes
Prices are shown on each product page. Polar adds the sales tax or VAT that applies where you live and shows the total before you pay. Business buyers may enter a tax ID at checkout where Polar supports it.
Delivery
Products are delivered digitally and immediately after payment. Your receipt email links to the files and your license key, and so does My purchases, where you sign in with a code sent to the email you bought with. Nothing is shipped.
Updates
New versions of a product are made available in My purchases as they are released, for the period the license states. We decide what goes into an update and when it ships.
Refunds
Refunds are covered by our refund policy. Polar issues refunds on our behalf, to the payment method you used.
Support
Write to support@appica.dev with questions about a product you bought. We reply within 2 business days. Support covers getting a product running as shipped and fixing defects in it; it does not include customizing a product for your project.
Warranty and liability
Products are provided “as is”. We work to keep them free of defects and compatible with the versions of their dependencies they name, but we don't guarantee they are suitable for any particular purpose. To the extent the law allows, our total liability for a purchase is limited to the amount you paid for it, and we are not liable for indirect or consequential losses. Nothing in these terms limits rights you have as a consumer that the law says can't be limited.
Changes to these terms
We may update these terms. The version in force on the day of your purchase applies to that purchase, and the date at the top of this page shows when they last changed.
Governing law
These terms are governed by the laws of England and Wales. If you are a consumer, this doesn't take away the mandatory protections of the law where you live, and if you live in the UK you can bring proceedings in the courts of the part of the UK where you live.
